SplitWish Terms of Service

1. Acceptance of Terms

By creating an account, downloading our mobile applications from the Apple App Store or Google Play Store, or accessing any service provided by SplitWish. and SG Infotech ("SplitWish", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to all provisions of these Terms, you must immediately discontinue use of the SplitWish mobile applications and services.

2. Eligibility & Account Registration

• Age Requirement: You must be at least 13 years of age (or 16 in the European Union) to register and use SplitWish.
• Account Integrity: You agree to provide accurate registration details (name, email address) and maintain the confidentiality of your credentials.
• Session Security: You are solely responsible for all activities occurring under your account. You must notify us immediately of any unauthorized access or security breach at security@splitwish.app.
• Account Revocation: We reserve the right to suspend or ban accounts that violate these Terms or engage in fraudulent activities.

5. User Content & Intellectual Property

• Your Content: You retain ownership of all receipt photos, avatars, comments, and expense notes you upload.
• License to SplitWish: You grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your uploaded content solely to provide group synchronization and receipt analysis services to you and your group members.
• SplitWish IP: All software, code, UI design, branding, algorithms, and documentation are the exclusive property of SplitWish. and SG Infotech. You may not reverse engineer, decompile, or copy our platform.

6. Acceptable Use & Prohibited Conduct

You agree not to engage in any of the following prohibited behaviors:

• Using SplitWish for money laundering, illicit financial schemes, or illegal gambling.
• Uploading defamatory, harassing, sexually explicit, or infringing content in notes or receipts.
• Attempting to probe, scan, or breach our server infrastructure, APIs, or real-time channels.
• Creating automated bots or scrapers to extract platform data.

7. Disclaimer of Warranties & Limitation of Liability

THE SPLITWISH SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPLITWISH TECHNOLOGIES INC. AND SG INFOTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO UNPAID GROUP DEBTS BETWEEN MEMBERS, INACCURATE RECEIPT SCANNING CALCULATIONS, ERRORS IN CURRENCY CONVERSIONS, OR SERVICE INTERRUPTIONS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF FIFTY US DOLLARS ($50.00 USD) OR THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless SplitWish., SG Infotech, their officers, directors, and employees from and against any claims, liabilities, damages, judgments, or expenses arising from your violation of these Terms or your interactions and debt disputes with other group members.

9. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising out of or related to these Terms shall first be resolved through good-faith informal negotiations before initiating formal legal proceedings or arbitration.

10. Modifications to Terms & Contact

We may update these Terms from time to time. When material changes occur, we will update the "Last Updated" date and notify users through an in-app notice. Continued use of SplitWish following changes signifies your acceptance.
